Note: The following terms and conditions have been translated for communication purposes only. The purchase is made on German ground and delivery is also made from Germany. With a confirmed order/purchase, international customers therefore recognize the German law as the applicable law as well as Germany as the place of jurisdiction. §1 Validity towards companies and definitions of terms

(1) The following General Terms and Conditions apply to all deliveries that take place between us and a consumer. The version valid at the time must be observed.
A consumer is any natural person who enters into legal transactions for purposes which are purposes which cannot be attributed primarily to their independent professional or commercial employment (see § 13 BGB).

§2 Conclusion of contract, storage of contract content

(1) The following provisions on the conclusion of a contract apply to all orders placed via the website http://www.blackcatstudioart.de.

(3) The presentation of the goods represents a non-binding invitation to the consumer to order goods. It is not a legally binding contractual offer on our part. This applies in particular to products that are available for pre-order or are available in limited editions. Also, we cannot and do not sell and ship to all countries (see §3). If an order is placed, the consumer submits a binding offer to conclude a contract.

(4) If we receive an order on our website, the following regulations must be observed: The consumer submits a binding contract offer by completing the order procedure on the website in accordance with the GTC.

The following steps are completed when ordering:
1) Selection of the available/pre-orderable product via photos on the website
2) Inquiry/expression of interest from the customer by e-mail to: mail@blackcatstudioart.de
3) Available models Reply email from Black Cat Studio -Art- with order confirmation and request for personal data and information on whether private or business customer for invoicing.

For pre-orders: reply email with confirmation of of inclusion in the pre-order list.As soon as the models are ready, you will receive an info mail on the current status and an order confirmation..

4) The binding order is placed when the potential buyer sends the necessary data

As soon as the order has been completed, a confirmation e-mail is sent. a confirmation e-mail is sent. This concludes the purchase contract.

If products are no longer available due to their limited availability, the customer will be informed of this upon request and a purchase is no longer possible due to the limited availability!

(5) Both the order data and our GTC will be sent to you by e-mail. The AGB can also be viewed online on the website at any time.

Bei Auftragsarbeiten: Antwortmail mit Ideen sowie eines Kostenvoranschlages bei gefallen. Sobald der Kostenvoranschlag bestätigt wird, wird das Modell vom Auftraggeber versendet und nach Erhalt bearbeitet. Über den aktuellen Stand wird regelmäßig informiert – ebenso, wenn sich Kosten erhöhen. Sobald das Modell fertig ist, ist die daraufhin gesendete Rechnung zu zahlen. Das Modell wird danach gemäß der in den AGB vereinbarten Zeiten versendet.

§3 Shipping costs, prices, payment options and due date

(1) The prices shown on this website are final prices plus shipping costs.

(a) In accordance with § 19 UStG no value added tax is charged and therefore not shown. Shipping costs will be added separately. Shipping and sales only to Germany, Ireland, UK, Belgium, Netherlands, Denmark, Italy, Slovenia, Czech Republic, Hungary and Finland. All other EU countries cannot be supplied due to the obligations and costs of implementing the packaging laws. Third countries (e.g. USA) on request.

(b) The cost of shipping is €6.99 + €2.00 packaging material. The costs may vary for larger order quantities. The customer will be informed promptly.

(c) All packages are insured and sent with a tracking number. 

(d) The return of sent packaging material is possible. Please write an e-mail for this purpose. 

(2) Payments are made by bank transfer for customers in Germany. International customers or customers from the EU can pay via PayPal upon request.

(3) Payment is made in advance: The customer is thus obliged to pay the purchase price immediately after the reimbursement of the purchase price immediately after conclusion of the contract.

§4 Dispatch of goods

(1) Insofar as the product description of an article does not allow any other conclusion, our products are ready for immediate shipment. This means that delivery will be made within 5 working days at the latest. When paying in advance, please note that the deadline for delivery begins on the day following the payment order to the transferring bank.
If the end of the period falls on a Saturday, Sunday or a public holiday at the place of delivery at the place of delivery, this shall be postponed to the next working day.

§5 Retention of title

We reserve title to the goods until the purchase price has been paid.

§6 Right of withdrawal

(1)If you are a consumer (i.e. a natural person who places the order for a purpose that cannot be attributed to your commercial or independent professional activity), you have a right of withdrawal in accordance with the statutory provisions.

(2)If you as a consumer make use of your right of withdrawal in accordance with section 4.1, you must bear the regular costs of the return shipment.

(3)In all other respects, the provisions set out in detail in the following shall apply to the right of withdrawal.

You have the right to withdraw from this contract within fourteen days without giving any reason. The withdrawal period is fourteen days from the day on which you or a third party named by you, who is not the carrier, have taken possession of the goods. of your decision to withdraw from this contract by an unequivocal statement (e.g. a letter sent by post or e-mail). You can use the attached sample withdrawal form, but this is not mandatory.

To meet the withdrawal deadline, it is sufficient for you to send your notification of exercising your right of withdrawal before the withdrawal period has expired.

Consequences of withdrawal

If you withdraw from this contract, we shall reimburse to you all payments received from you, including the costs of delivery (with the exception of the supplementary costs resulting from your choice of a type of delivery other than the least expensive type of standard delivery offered by us), without undue delay and in any event not later than 14 days from the day on which we are informed about your decision to withdraw from this contract. For this repayment, we will use the same means of payment that you used for the original transaction, unless expressly agreed otherwise with you; in no case will you be charged any fees for this repayment. We may refuse repayment until we have received the goods back or until you have provided proof that you have returned the goods, whichever is the earlier.

You must return or hand over the goods to us immediately and in any case within fourteen days at the latest from the day on which you inform us of the revocation of this contract. The deadline is met if you send the goods before the period of fourteen days has expired. You shall bear the direct costs of returning the goods. You only have to pay for any loss in value of the goods if this loss in value is due to handling of the goods that is not necessary for checking their condition, properties and functionality.

The right of withdrawal does not apply to the following contracts:
Contracts for the supply of goods which are not prefabricated and for the manufacture of which an individual selection or determination by the consumer is decisive or which are clearly tailored to the personal needs of the consumer.

German is the only contractual language.
